5-13-9: RESTRICTIONS ON TIME OF SALE 1 :
No alcoholic liquor shall be sold, delivered, transferred, distributed or given away upon or about any licensed premises by anyone at any time except those times permitted by this section.
   (A)   General Restrictions On Time Of Sale: No alcoholic liquor shall be sold, delivered, transferred, distributed or given away upon or about any licensed premises by anyone except during the following periods of time on the following days:
      1.   On the days of Monday through Saturday from six o'clock (6:00) A.M. to one o'clock (1:00) A.M. of the following day.
      2.   For those licenses only which permit the sale of alcoholic liquor on Sundays: On Sundays from eleven o'clock (11:00) A.M. to eleven o'clock (11:00) P.M. Notwithstanding the foregoing, a licensee having a Class A-1, B-1, E-1, F-1, G-1 or O license may remain open to the public to sell, deliver, transfer or distribute alcoholic liquor on Sundays from six o'clock (6:00) A.M. to eleven o'clock (11:00) P.M. A licensee having a temporary license as defined in subsection 5-13-5(M), and sections 5-13-19 and 5-13-19-5 of this chapter may apply for written permission from the Local Liquor Control Commissioner, which permission may be given in his or her sole discretion, to sell, deliver, transfer or distribute alcoholic liquor on Sundays from six o'clock (6:00) A.M. to eleven o'clock (11:00) P.M.
      3.   A licensee having a Class F, F-1, F-2, G-1, I, or I-1 license may remain open to the public to sell, deliver, transfer, distribute or give away alcoholic liquor only: a) during regular retail store hours, b) during times specified in this section, and c) on the days specified for that license.
   (B)   New Year's Eve Exception: On the evening of December 31 of one year to January 1 of the following year (which period is commonly known as New Year's Eve), licensed premises may sell alcoholic beverages from six o'clock (6:00) A.M. of December 31 of one year until one o'clock (1:00) A.M. on January 1 of the following year. If December 31 of any year is a Sunday, alcoholic liquor may be sold between the hours of twelve o'clock (12:00) noon on December 31 to one o'clock (1:00) A.M. of January 1 of the following year.
   (C)   Holiday Exception: On the Sunday evening of any Sunday which precedes a legal holiday as affirmed by the Mayor of the City of Dixon, licensed premises may sell alcoholic beverages until one o'clock (1:00) A.M. of the following day. This exception shall only apply in those instances where the Mayor of the City of Dixon has affirmed that the Monday following the Sunday in question is a legal holiday.
   (D)   Rules For Class O License: Alcoholic liquor may be sold, delivered, transferred, distributed or given away on the premises during no more than thirty (30) hours per calendar month. The holder of a Class O license shall, at least five (5) days before the commencement of each month, provide the Local Liquor Control Commissioner with a written schedule of anticipated hours for the following month, including closing times. The schedule may be amended only upon the prior approval of the Local Liquor Control Commissioner. Nothing in this subsection shall limit the ability of the holder of Class O license to apply for a temporary license under subsection 5-13-5(M) of this chapter.
   (E)   Rules For Class N: No beer or wine brought onto the premises of a Class N license may be consumed after ten o'clock (10:00) P.M. on days the licensee is open. All beer and wine shall be removed from the licensed premises at that time. Opened beer and wine shall be disposed of pursuant to section 5-13-5(S) of this chapter. Patrons with unopened beer or wine shall be required to leave the licensed premises or dispose of the same pursuant to section 5-13-5(S) of this chapter.
   (F)   Rules for Class P License: Alcoholic liquor may be sold only in strict conformance with the requirements set forth in section 5-13-5(V) of this chapter.
   (G)   Rules For Class T License: Alcoholic liquor may be sold only in strict conformance with the requirements set forth in subsection 5-13-5(W) of this chapter. (Ord. 1610, 8-19-1991; amd.
