5-13-19: TEMPORARY LICENSE FOR THE ANNUAL CITY FAIR:
   (A)   Issuance Of License:
      1.   The local liquor control commissioner is hereby authorized to issue two (2) licenses for the sale of "beer" and "wine" only as defined in this chapter to a corporation chartered by the state as the corporation having as its primary purpose the establishment, maintenance and operation of the celebration commonly referred to as the Petunia Festival which has been designated as the official city fair or, to the Dixon chamber of commerce for the maintenance and operation of the celebration referred to in this subsection.
      2.   Each license issued by this section shall be designated "city fair license" and shall not exceed two (2) in number per calendar year. (Ord. 1611, 8-19-1991)
   (B)   Restrictions On Locations:
      1.   The licenses issued pursuant to this section may be issued for use at the following premises:
         (a)   The premises owned by the Dixon park district provided said premises are within the corporate limits of the city of Dixon and comply with state statutes and local ordinances concerning location of authorized premises with the exception of the ordinances on zoning;
         (b)   The premises owned by the city of Dixon and commonly known as the Dixon Airport; or
         (c)   The parking lot owned by the city of Dixon and commonly known as the Beanblossom Parking Lot. (Ord. 2788, 6-21-2010)
      2.   If the license authorized by subsection (B)1(a) of this section is to be issued for the premises owned by the Dixon park district, such license shall not be issued without the express written approval of the board of commissioners of the Dixon park district as evidenced by the execution of a valid lease to said premises by the licensee and the board of commissioners of the Dixon park district.
      3.   If the license authorized by subsection (B)1(b) of this section is to be issued for the premises known as the Dixon Airport, such license shall not be issued without the express written approval of the Dixon airport board as evidenced by the execution of a valid lease agreement to said premises between the licensee and the Dixon airport board.       4.   The sale and consumption of beer and wine shall be confined to the licensed premises.
      5.   All beer and wine sold shall be served only in disposable containers. (Ord. 1431, 6-20-1988)
   (C)   Restriction On Period Of License For The Dixon Park District Premises: The license issued for the premises owned by the Dixon park district shall be issued for the limited period of the duration of the annual city fair as determined by the liquor control commissioner in the issuance of the license pursuant to subsection (A) of this section.    (D)   Restrictions On Time Of Sale At The Dixon Park District Premises: For the days designated as the city fair, the sale of beer and wine shall be authorized from twelve o'clock (12:00) noon to twelve o'clock (12:00) midnight. After that time all persons shall vacate the licensed premises with the exception of those employees and agents of licensee who are delegated to operate, control, maintain, and clean the premises. All beer and wine shall be removed from the licensed premises no later than one hour after the closing time on the days when sale of beer and wine is authorized. (Ord. 2539, 7-1-2005)
   (E)   Restrictions On City Owned Locations:
      1.   Restrictions On Dixon Airport Premises: The Dixon airport board shall establish such rules, regulations and restrictions, including the date, time, place, location and such other limitations as it deems necessary to govern the use of the premises for which the license to be used at the Dixon Airport is issued. Such rules, regulations, and restrictions shall be consistent with all federal, state, and city laws, ordinances, rules and regulations and shall be incorporated in the lease agreement provided for in subsection (B)3 of this section.
      2.   Restrictions On Beanblossom Parking Lot: The license issued for the premises known as the Beanblossom Parking Lot shall be issued for one day only, shall authorize the sale of beer and wine only, shall not permit the sale of beer and wine later than six o'clock (6:00) P.M., and shall be limited by such other rules, regulations and restrictions as the local liquor control commissioner deems necessary to govern the use of the premises.    (F)   Restrictions On Persons Of Nonage:
      1.   No person under the age of twenty one (21) years shall purchase, attempt to purchase, possess, or consume any beer or wine or other alcoholic beverage upon either licensed premises or other premises controlled by the licensee during the license period. (Ord. 1431, 6-20-1988)
      2.   Persons of any age are authorized to be present on the licensed premises issued as a city fair license under subsection (B)1(a) of this section. Persons under the age of twenty one (21) are authorized to be present on the premises licensed under subsection (B)1(c) of this section during the time for which the temporary license has been granted for the purpose of purchasing food and nonalcoholic beverages only.    (G)   Removal From Premises: Any duly authorized representative of licensee and any peace officer of the city, county of Lee or Dixon park district are hereby empowered to remove any person from either licensed premises where such officer or agent has probable cause to believe that such person may be under the influence of intoxicating beverages.
   (H)   Fee: The total annual fee for licenses shall be one dollar ($1.00). (Ord. 1262, 4-1-1985)
   (I)   Construction: It is the intent of the city council that this section of the liquor code be liberally construed for the express purpose of fulfilling the intent of allowing the sale of beer and wine only at the city fair under the restrictive terms provided herein. Unless specifically excepted within this section all of the terms and provisions of this code remain in full force and effect. (Ord. 1431, 6-20-1988)
