§ 51.047  EXTENSION OF WATER MAINS WITHIN THE CITY.
   The Water Superintendent shall be authorized to construct, or cause to be constructed, extensions to the water system if any one of the following conditions exists:
   (A)   The annual anticipated revenue made available to the city from the customers to be immediately served by such extension is not less than one-tenth of the actual cost to the city for the construction of said extension;
   (B)   The Water Superintendent declares that the water main extension is needed for the overall benefit and improvement of the entire water distribution system; or
   (C)   The city approves a contract for the construction of the extension with a party or parties desiring water service; provided that, subdividers or developers within or adjacent to the city shall construct at their own expense all water mains within their subdivisions or developments. The above-referenced water connection fee will not apply to or be charged against the reconstruction of any existing water service line serving any existing dwelling, building, or the like. It is intended that this water connection fee be charged only where a new building is being constructed on previously undeveloped property or where an existing building is being connected to the water system without its property owner having previously executed a water subscription agreement with the city.
