§ 152.036 MARINE WATERWAY ZONE M-W.
   In an M-W Zone, the following regulations shall apply.
   (A)   Uses permitted outright. In an M-W Zone, the following uses and their accessory uses are permitted, subject to the provisions of §§ 152.055 through 152.076, 152.115 through 152.117, and 152.225 through 152.235, and to the estuarine plan, where applicable: a use permitted outright as indicated in the permitted use matrix of the estuarine plan, specific to the estuarine management unit within which the use is proposed.
   (B)   Conditional uses permitted. In an M-W Zone, the following uses and their accessory uses may be permitted, subject to the applicable provisions of §§ 152.055 through 152.076, 152.115 through 152.117, 152.130 through 152.136, and 152.225 through 152.235, and the estuarine plan. A conditional use as indicated in the permitted use matrix of the estuarine plan, specific to the estuarine management unit within which the use is proposed.
   (C)   Standards. All uses permitted outright or as conditional are subject to the estuarine standards of the estuarine plan. In addition to the requirements of this chapter, a conditional use within the M-W Zone may be allowed only when findings in accordance with the provisions of the estuarine plan (conditional uses) are made.
