§ 95.999 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   Any person, firm, or corporation violating any provisions of §§ 95.001 through 95.018 shall be liable to the city and shall pay the city the actual damages incurred by the city as a result of the violation or a default.
      (2)   In the event the city is required to obtain the services of an attorney to enforce the provisions hereof or to collect damages incurred, the city shall, in addition, be entitled to recover its reasonable attorneys fees and other collection costs.
      (3)   No new excavation permits will be issued to any person whose work has necessitated city action.
   (C)   Any person violating any provision of §§ 95.065 through 95.068 shall, upon conviction thereof, be punished by a fine of not more than $500 for each separate offense. In addition to any fine, the court shall impose any reasonable court costs, including but not necessarily limited to reasonable attorney’s fees incurred by city in prosecuting the defendant.
