1311.05 ENFORCEMENT PROCEDURES.
   (a)    The Building and Zoning Commissioner shall grant or deny permits, issue stop work Orders and take other enforcement action in conformity with and utilizing the procedures provided for by the Ohio Building Code in connection with the approval of all work to which the Code applies. Appeals of any determination made by the Commissioner shall be directed to the Ohio Board of Building Appeals.
   (b)    The Building and Zoning Commissioner shall grant or deny permits, issue stop work Orders and take other enforcement action in conformity with the Ohio Residential Code for One, Two and Three Family Dwellings in connection with the approval of all work to which the Code applies and, in doing so, shall, to the extent practicable, utilize the document forms and procedures established by the Ohio Building Code for like-kind activities in connection with work governed by the Ohio Building Code. Appeals of any determination made by the Commissioner shall be directed to the Board of Zoning and Building Appeals.
   (c)    The Building and Zoning Commissioner shall grant or deny permits, issue stop work Orders and take other enforcement action in conformity with the Permanent Foundations Guide for Manufactured Housing in connection with the approval of all work to which the Guide applies and, in doing so, shall, to the extent practicable, utilize the document forms and procedures established by the Ohio Building Code for like-kind activities in connection with work governed by the Ohio Building Code. Appeals of any determination made by the Commissioner shall be directed to the Board of Zoning and Building Appeals.
   (d)    The Building and Zoning Commissioner shall grant or deny permits, issue stop work Orders and take other enforcement action authorized or required by Chapter 1333 of the Codified Ordinances in conformity with the procedures set out in said Chapter 1333 and, in doing so, shall, utilize document forms and procedures recommended or approved by the Ohio Department of Natural Resources or Federal Emergency Management Agency. In the absence of such recommended or approved document forms or procedures, the Commissioner shall, to the extent practicable, utilize the document forms and procedures established by the Ohio Building Code for like-kind activities in connection with work governed by the Ohio Building Code. Appeals of any determination made by the Commissioner shall be directed to the Board of Zoning and Building Appeals.
   (e)    The Building and Zoning Commissioner shall grant or deny permits, issue stop work Orders and take other enforcement action authorized or required by Chapters 1337 and 1341 of the Codified Ordinances in conformity with the requirements of said chapters and, in doing so, shall, to the extent practicable, utilize the document forms and procedures established by the Ohio Building Code for like-kind activities in connection with work governed by the Ohio Building Code. Appeals of any determination made by the Commissioner shall be directed to the Board of Zoning and Building Appeals.
   (f)   In all cases in which the Building and Zoning Commissioner has knowledge of the existence of housing conditions that fail to meet the minimum standards established by Section 1335.02 of the Codified Ordinances, of the existence of a structure that has not been maintained in conformity with the requirements of Chapter 1339 or of land that has not been maintained in conformity with the requirements of Chapter 1341, the Commissioner shall issue a Notice and Order to all owners of record of the real estate on which such conditions exist. The Notice and Order shall itemize all conditions requiring correction and order remedial action that, if taken, will conform the property to the requirements of this Building Code. The Notice and Order shall specify a reasonable time within which the remedial action is to be completed and advise the owner of the procedure for Appeal. The Notice and Order shall be deemed served at the time of delivery to each person entitled thereto by any means authorized for the service of summons in a Civil Action by Rule 4 of the Ohio Rules of Civil Procedure. Appeal of any Order made by the Commissioner shall be directed to the Board of Zoning and Building Appeals.
   (g)    In all cases in which the Building and Zoning Commissioner has knowledge of the existence of a dangerous structure as defined by Section 1339.04 of the Codified Ordinances he shall issue a Notice and Order conforming to the requirements of subsection (f) hereof to all owners of record of the real estate on which such conditions exist. The remedial action Ordered by such Notice and Order shall be demolition of the dangerous structure within the time allowed by the Notice and Order when, in the opinion of the Commissioner, the structure cannot be repaired so that it will conform to the requirements of this Building and Housing Code or that the cost to correct all conditions itemized in the Notice and Order will exceed fifty percent of the value of the structure. In all cases in which the Notice and Order issued pursuant to this section includes an Order requiring demolition of the structure, a copy of the Notice and Order shall be served upon all persons holding a valid mortgage against the premises in any manner authorized for service upon an owner of the property. Appeal of any Order made by the Commissioner shall be directed to the Board of Zoning and Building Appeals.
   (h)    Whenever the Building and Zoning Commissioner determines that a structure is a dangerous structure and that continued occupancy or use thereof constitutes an imminent threat to human life or health, he shall order the premises, or so much thereof as are deemed dangerous, vacated and shall conspicuously post on the structure, and on any lands surrounding the structure rendered dangerous by the condition of the structure, placards clearly stating that the structure and any surrounding grounds so posted are unfit for use and prohibiting entry by any person other than those engaged in the repair or demolition of the structure.
