ADOPTING ORDINANCE NO. 6017
AN ORDINANCE APPROVING THE 1999 CODIFIED ORDINANCES, ADOPTING NEW MATTER, AMENDING AND REPEALING OBSOLETE AND CONFLICTING PROVISIONS, AND DECLARING AN EMERGENCY.
   WHEREAS, the Municipal Ordinances of a permanent and general nature should be recodified, and;
   WHEREAS, Council employed the services of the Walter H. Drane Company to prepare and publish such recodification; and
   WHEREAS, the recodification of such Ordinances, together with the new matter to be adopted, matters to be amended and matters to be repealed are before Council;
   Now therefore, be it enacted by the Council of the Municipality of Defiance, Ohio, that:
   Section 1: The general and permanent Ordinances of the City of Defiance, Ohio, as revised, rearranged and consolidated into component codes, titles, chapters and sections entitled, “Codified Ordinances of the City of Defiance, Ohio, 1999" are hereby approved, adopted and enacted.
   Section 2: All Ordinances and Resolutions or parts thereof enacted prior to March 1, 1999, that are inconsistent with any provision of the Codified Ordinances enacted by Section 1 are hereby repealed as of the effective date of this Ordinance except that this Ordinance shall not:
   A.   Affect any right or liability accrued or incurred prior to the effective date of this Ordinance or any action or proceeding for the enforcement thereof;
   B.   Relieve any person from punishment for an act committed prior to the effective date of this Ordinance or any proceeding for the prosecution thereof;
   For such purposes, all previously enacted Ordinances shall continue in full force notwithstanding repeal by this Ordinance for the purpose of revision and recodification.
   Section 3: An abstract of this Ordinance shall be published as authorized by Section 2.11 of the Charter and no other publication shall be necessary.
   Section 4: Each Section of the Codified Ordinances without an Ordinance or Resolution history cited at the end thereof is new material enacted by this Ordinance.
   Section 5: The authentication and approval of this Ordinance by the Mayor and Clerk of Council shall constitute certification that the permanent and general Ordinances of the City of Defiance in effect on March 1, 1999, are correctly set forth in, “Codified Ordinances of Defiance, Ohio, 1999".
   Section 6: It is found and determined that all legislative actions pertaining to the adoption of this Ordinance were taken in Public Session and that all deliberations that affected or influenced any such legislative act, including all deliberations in Committee, were conducted in Public Session duly convened in accordance with law.
   Section 7: This Ordinance is declared to be an emergency measure necessary for the preservation of the health, safety and welfare of the community for the reason that there is an imperative necessity to publish and distribute the Codified Ordinances to the officials and residents of the Municipality to avoid legal entanglements, including potential conflicts with general State laws, and facilitate public administration and the administration of criminal justice. As such, this Ordinance shall be effective immediately upon passage by a 3/4th majority of Council and approval of the Mayor.
