The City Administrator may waive payment of up to 50% of the costs incurred by the municipality to take actions authorized by Section 927.10 or 927.11 of the Codified Ordinances in consideration of the performance of compensatory actions to improve public compliance with this Chapter or remediate environmental damage caused by illicit discharges for which the person from whom such payment is due is not responsible. Compensatory actions may include, but are not limited to: stenciling of storm drains, removal of litter or other contaminants from streets, roads or water courses, sponsorship of a public education workshop. In negotiating any agreement to accept the performance of compensatory actions in lieu of payment, the City Administrator shall consider the financial capacity of the person from whom payment is due to make the required payment without undue financial hardship and the environmental benefit and cost benefit to the municipality to be realized by the compensatory action.
