927.11 ENFORCEMENT MEASURES FOLLOWING ISSUANCE OF A NOTICE OF VIOLATION.
   Upon the failure of any person to whom a Notice of Violation is issued in to complete the remedial actions therein required by the date stated in the Notice of Violation, or to complete the remedial actions required by the determination issued at the conclusion of any Appeal of such Notice by the date stated in the determination, the City Administrator may:
   (a)   Suspend water service to the premises;
   (b)   Obstruct any outfall or other connection to the MS4 to stop an illicit discharge or prevent any illicit discharge that may be threatened by the existence of an illegal connection or other condition of or on the premises;
   (c)   Enter upon the premises and take all actions reasonably required to implement the remedial actions required by the Notice of Violation or Determination issued following appeal;
   (d)   Restore any land, MS4 facility or other property damaged or adversely impacted by the occurrence of an illicit discharge determined to have been caused by the event(s) or condition(s) described by the Notice of Violation to the degree and in the manner required to be undertaken by the person to whom the Notice of Violation was issued, provided, however, that no entry shall be made on private lands or property not owned or occupied by the person to whom the Notice of Violation was issued without express permission of the owner or occupant of the lands to be restored.
   (e)   With concurrence of the City Law Director, commence and maintain an action in any Court of competent jurisdiction to secure injunctive relief obligating the person or persons to whom the Notice of Appeal was addressed to: cease water use practices or industrial or commercial operations that produce effluent that has been detected in an illicit discharge; remove illegal connections, adopt or amend a Stormwater Pollution Prevention Plan or otherwise comply with the remedial requirements of the Notice of Violation or determination issued upon Appeal of the Notice of Violation.
