905.10 MAINTENANCE OF PAVING-BLOCK SIDEWALKS.
   (a)    A sidewalk composed of paving blocks shall be deemed free of hazard and in satisfactory compliance with the duty imposed under Section 905.08 if the adjacent property owner maintains the sidewalk so that none of the following conditions is permitted to exist:
(1)    Stubtoes. The vertical misalignment of any paving block or series of blocks in excess of one inch above the median path surface level;
(2)    Irregular slope.
A.    Transverse (lateral) slope. Having fixed the median surface level, no variation in slope, either toward the street or the adjacent property, at a ratio of more than five-eighths of an inch per horizontal foot; and
B.    Longitudinal slope. Having fixed the sidewalk surface level along the path of the adjoining sidewalks, no deviation of the blocked area from the average line of the sidewalk at a ratio of more than one inch per foot;
(3)    Gaps. Gaps resulting from missing paving blocks, disintegrated paving blocks or the separation of paving blocks in excess of one inch in width;
(4)    Surface quality. The paving blocks to form a smooth surface level with adjacent pavements when measured longitudinally and laterally. Blocks in the pavement shall be kept tightly together to prevent the wobbling of any section of the path by any means commonly in use.
(5)    Drainage. Any surface irregularity that allows impounding of water for more than one square foot in area.
   (b)    When any of the conditions set forth in subsection (a) hereof exists to a degree equal to or greater than that specified, the sidewalk shall be deemed hazardous and the adjoining owner shall be under a continuing duty to reconstruct the defective sidewalk in conformity with the specifications for sidewalk construction and reconstruction contained in Section 905.11. If defects in the sidewalk can be corrected by resetting a section or sections of the surface, not exceeding one-fourth of the aggregate surface area of the sidewalk for which the adjacent property owner is responsible, resetting may be permitted in a manner acceptable to the City Engineer.
