§ 98.35 NOTICE.
   (A)   The Tree Commission shall have the authority to investigate or cause to investigate any complaints or reports of trees or shrubs which may constitute a public nuisance as defined in § 98.01. If it is determined by the Tree Commission that a tree or shrub growing on private property constitutes a public nuisance in violation of this chapter, then the owner shall be notified in writing of the violation.
   (B)   Any notice required under this chapter shall be served personally or by certified U.S. mail to the owner or co-owner at the last known address, or if the owner or co-owner cannot be served personally or by certified U.S. mail, then by publishing it once in a newspaper of general circulation within the village. If an emergency, as defined in § 98.36(B), exists, then notice by publication shall not be necessary for the trimming or removal of a tree or shrub by the village.
