§ 98.36 REMEDIAL EFFORTS.
   (A)   Upon being notified by the Tree Commission that a public nuisance exists in violation of this chapter, the property owner shall have 30 days from the date of the notice to remedy the violation. If the nature of the violation constitutes an emergency, then the owner shall have seven days from the date of the notice to remedy the violation. In the event the property owner, after receiving notice, fails to trim or remove any tree or shrub in accordance with the provisions of this chapter in the specified time, then the Mayor is hereby authorized to have enforced the provisions of this chapter, to cause to be trimmed or removed the tree.
   (B)   The following conditions constitute an emergency:
      (1)   Any tree or portions of a tree infected with the fungus (ceratociptis ulmi) causing Dutch Elm disease;
      (2)   Any tree which is dead or has dead limbs or branches causing an immediate hazard to persons or property.
