For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
PUBLIC NUISANCE. Any tree or shrub or parts thereof growing upon private property or in the tree lawn which overhangs or interferes with the use of any street, alley, park or other public place within the village, or harbors insects or disease which constitutes a threat to other trees within the village or because of the condition of the tree or shrub presents a hazard to persons or property.
TREE LAWN. The space between the street curb and the sidewalk, or if there shall be no street curb or sidewalk, then that space within five feet of the edge of the street surface.
