The occupancy of a building shall not be changed unless the new user or occupant of the building obtains a certificate of occupancy from the Building Commissioner certifying that the building and the building service equipment therein conform to the requirements of this Building and Housing Code for buildings of the proposed new occupancy.
Occupancy permits must also be obtained prior to occupying or moving in “as-is” existing facilities or buildings. The Building Commissioner shall authorize the issuance of permits required for occupying or moving in “as-is” existing facilities or buildings and shall collect the fees therefor in accordance with Section 1442.16:
If occupancy occurs prior to the issuance of a permit, all occupancy fees shall be doubled, including inspection fees.
