246.11 PROBATIONARY PERIODS.
   (a)   The probationary period for initial appointments in the Police Department shall extend for 365 days from the date of employment, exclusive of days conducting Ohio Peace Officer Training pursuant to Ohio R.C. 109.75, as amended. If the appointee holds a valid, current Ohio Peace Officer Certificate at the time of the appointment, the probationary period shall be for 365 days from the time of the initial appointment.
   (b)   The probationary period for all initial appointments in the Fire Department shall be 365 days from the date of employment, except that the probationary period shall not be considered successfully completed until, among all other requirements, the appointee obtains a certificate of competency in Emergency Medical Technician - Paramedic, as required by Section 246.12 and Ohio R.C. 4765.30 and 4765.39, as amended.
   (c)   Promotional appointments in the Police or Fire Department, with the exception of the Police Chief and Fire Chief, shall be subject to a probationary period of one year. Such period may be extended by the Mayor with the approval of Council for good cause shown by the Police Chief or Fire Chief for a period not to exceed an additional six months.
   (d)   No initial appointment or promotion shall be deemed final until the appointee has successfully served his or her probationary period. At the end of the probationary period, the Chief of the department will transmit to the Mayor a record of the employee's service, together with a recommendation as to whether the employee has satisfactorily served his or her probationary period. The Mayor will then make a determination as to whether the appointee has satisfactorily served his or her probationary period. If such service is satisfactory, the appointee shall continue in his or her rank.
   (e)   If, at the end of the probationary period, the appointee's service is deemed unsatisfactory by the Mayor, then with the approval of Council, he or she shall be terminated from the department if he or she had received an initial appointment in the Police Department, or he or she shall be reduced to the rank held at the time he or she was appointed to the higher rank if he or she received a promotional appointment. In all cases of unsatisfactory probationary periods, the Mayor shall furnish the employee with written notice of an unsatisfactory probation and a statement of the basis for such finding.
