307.99 PENALTY.
   (EDITOR’S NOTE: See Section 303.99 for General Code penalty.)
   (a)   Compliance With Order of Police Officer; Fleeing. Whoever violates Section 307.01 is guilty of failure to comply with an order or signal of a police officer. A violation of Section 307.01(a) is a misdemeanor of the first degree. A violation of Section 307.01(b) is a misdemeanor of the first degree, unless the jury or judge as trier of fact finds any one of the following by proof beyond a reasonable doubt:
      (1)   In committing the offense, the offender was fleeing immediately after the commission of a felony;
      (2)   The operation of the motor vehicle by the offender was a proximate cause of serious physical harm to persons or property;
      (3)   The operation of the motor vehicle by the offender caused a substantial risk of serious physical harm to persons or property.

   (b)   Accidents. Except as otherwise provided in this subsection, whoever violates any provision of Section 307.03 to 307.05 is guilty of a misdemeanor of the first degree. Whoever violates Section 307.03 or 307.04 when the accident or collision that is the basis of the violation results in serious physical harm or death to a person is guilty of a felony and shall be prosecuted under appropriate State law.
