921.04 UNPAID CHARGES A LIEN ON THE PREMISES AS AUTHORIZED BY STATE LAW.
(a) The City hereby adopts as if fully rewritten herein any and all provisions of the Ohio Revised Code providing for the levying of a lien upon property for unpaid water and sewer utilities, as the same may be amended from time to time. Except as otherwise provided herein, any such lien shall be certified in accordance with the procedures provided by the Ohio Revised Code.
(b) Before certifying a lien to the County for non-payment of utilities, the City shall first follow the termination procedures of Section 921.08, and apply any deposit to the unpaid balance. Upon application of a deposit to an unpaid balance, utility service shall not be restored until the payment of a new deposit. A person adversely affected by a lien may appeal the lien to the Director of Finance, provided that such appeal shall be limited to the questions of whether the utility bill is indeed delinquent and whether the City followed all proper procedures in certifying the lien. Such appeal shall be filed within 10 calendar days after service of a notice of the lien to the property owner.
