921.08 TERMINATION PROCEDURES.
   (a)   Residential Terminations.
      (1)   If the City determines that a residential customer is delinquent in rendering payment for utility service, the City may, after proper and reasonable notice of pending termination of service to the customer and owner of the premises not less than seven days, terminate the customer’s service during normal City business hours in compliance with the following conditions:
         A.   The City shall provide the customer with written notice to the customer’s address informing him that:
            1.   Sources of federal, state or local aid for payment of utility bills may be available; and
            2.   A minimum payment plan may be entered into in the event the customer establishes a present inability to pay the amount due in full; and
            3.   The City business address and telephone number of a City representative in the event the customer has a dispute regarding the reasons for termination.
         B.   No delinquent bill disconnections may be made after 12:30 p.m. on the day preceding a day that all services necessary for the customer to arrange and the City to perform re-connection of service are not regularly performed.
         C.   On the day and at the time of termination of service, the City shall provide the customer with written notice to the dwelling where services are to be terminated. In a multi-unit dwelling, written notice shall be placed in a conspicuous place.
         D.   Termination of residential service for nonpayment may be delayed when a customer notifies the City that termination of service would be especially dangerous to health or would make operation of necessary medical or life supporting equipment impossible or impracticable, so long as the customer establishes an inability to pay the amount due and enters into and makes payments in accordance with an extended payment plan.
   (b)   Commercial Termination (Non-residential).
      (1)   If the City determines that a commercial (non-residential) customer is delinquent in rendering payment for utility service, the City may, after proper and reasonable notice of pending termination of service to the customer and owner of the premises of not less than seven days, terminate the customer’s service during normal City business hours in compliance with the following conditions:
         A.   No delinquent bill disconnections may be made after 12:30 p.m. on the day preceding a day that all services necessary for the customer to arrange and the City to perform re-connection of service are not regularly performed.
         B.   On the day and at the time of termination of service, the City shall provide the customer with written notice to the premises where services are to be terminated. In premises with multi-units, written notice shall be placed in a conspicuous place. Notices shall inform the customer that:
            1.   A minimum payment plan may be entered into in the event the customer establishes a present inability to pay the amount due in full; and
            2.   The City business address and telephone number of a City representative in the event the customer has a dispute regarding the reasons for termination.
