6-5-2: Violation; Penalties
6-5-1: FIREWORKS PROHIBITED:
   A.   It is unlawful to possess, sell, use or explode fireworks as defined in Section 50-37-101 Montana Code Annotated within the city limits of the City of Cut Bank, Montana, at any time.
   B.   For purposes of this chapter, possess or possession means that the person who is in a public place or outdoors at a residence has fireworks in hand or in their immediate physical control when said fireworks are in such a state as to be immediately lit or exploded or otherwise utilized. 6-5-2: VIOLATION; PENALTIES:
Any person, firm, partnership, association, or corporation violating the provisions hereof shall be guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than $100.00 or more than $500.00. Second or subsequent convictions should be fined more than the prior conviction. A third or subsequent conviction may also include a jail sentence of up to ten (10) days in the Glacier County Detention Center. (Ord. 387, 6-15-1992; amd. 2006 Code; Ord. 8.20, 9-6-2016)
