(A) (1) In the event a determination is made by any law enforcement officer that a person is in violation of § 94.01, the prohibition concerning possession of intoxicating and alcoholic beverages in the Town Park or of having an open container of alcoholic beverages within the Town Park, except for the exempted special event, the officer may proceed to enforce the prohibition under all existing ordinances and other laws including:
(a) The officer may order the person possessing said substance to immediately dispose of the alcoholic beverage in said container.
(b) Issue a citation in the amount of $100 per violation.
(2) Payment of such fine shall be paid to the Town Clerk/Treasurer within 30 days of the violation being issued. The town may enforce the collection of such fines through any court of competent jurisdiction and may seek a judgment against the violator.
(3) In the event enforcement action is required in order to collect the fine and/or obtain a judgment, the violator shall also be subject to reasonable attorney fees and costs of collection.
(B) Penalties will be assessed for violation of the speed limit in § 94.02 as are assessed normally by the Police Department and set out in Indiana Code and in the other traffic ordinances. Notice of violation shall be given on the Uniform Traffic Citation, serially numbered, and processed as any other speed violation for the town.
(C) For any violation of the parking provisions in §§ 94.03 or 94.04, a standard $3 parking ticket will be issued against the registered owner of any trailer herein. In addition to the parking violation, the vehicle will be towed at the expense of the owner. It will be the responsibility of the registered owner to pay in addition to the parking ticket the towing expense, any additional expenses incurred for the keeping and storing of the towed vehicles and trailer.
(D) Violations of § 94.06, regarding the enforcement of park hours of operation as well as overnight parking, shall be fined a minimum of $100.
(E) Anyone found to violate any provision of §§ 94.07 or 94.08 shall be assessed a fine of $25 for a first offense, $50 for a second offense, and $100 for a third and any subsequent offense, half of which fine may be performed as community service in the park by any violator at the rate of one hour service per $1 fine, with the balance of any fine to be placed in the Park and Recreation Fund to be used by the Park Board for park purposes.
