All owners of residential dwelling units within the Village are required to utilize the services of and maintain an account with the residential garbage collection company who is awarded the exclusive license by the Village for the collection of residential garbage. All residential dwelling unit owners shall be required to pay service charges for residential garbage collection as required by Section 7-2-3-6 of this Code. In the case of rented residential dwelling units, it shall be the duty of the property owner to ensure the timely payment of the service fees.
Residents shall not share garbage containers or accounts without the written permission from the Health and Safety Committee of the Village Board.
If a resident maintains a dwelling unit as well as a commercial business establishment, the resident may utilize the same garbage collection service that provides garbage collection for the commercial business establishment without using the Village's licensed residential garbage collection company, provided the property owner obtains a variance from this Section 7-2-3-10 in accordance with section 7-2-7 of this Chapter, and further provided the following conditions exist:
(A) The same person owns both the commercial business establishment and the dwelling unit; and
(B) The garbage collection service utilized by the commercial business establishment is available to the occupants of the dwelling unit and is adequate to meet the garbage disposal needs of both the commercial business establishment and the dwelling unit; and
(C) The garbage container used for the dwelling unit satisfies the requirements of section 7-2-2-1(B) of this Chapter. (Ord. 899, 2-28-2020)
