§ 113.28 ROADWAY DONATION SOLICITATION PERMIT ELIGIBILITY; TERMS AND CONDITIONS.
   All roadway donation solicitation permits are subject to the following terms and conditions:
   (A)   Each permit shall be valid only on one consecutive Friday and Saturday per year; provided, however, in the even of inclement weather during any two-day period, the Village Clerk shall assign the person to whom the permit applies an alternate two-day period.
   (B)   No person shall be granted more than two permits per calendar year.
   (C)   Only persons exempt from taxation pursuant to IRS Code § 501(c)(3) or other bona-fide not-for-profit organizations are eligible to apply for and receive roadway donation solicitations.
   (D)   An entity shall be considered a bona-fide not-for-profit organization for the purposes of this section if it:
      (1)   It has be chartered, incorporated or otherwise in existence for at least five years prior to the date the entity make application for a roadway donation solicitation permit;
      (2)   Does not produce profits or income of any kind for its owners, founders or organizers; and
      (3)   Has any of the following purposes: charitable, benevolent, educational, civic, patriotic, political, religious, literary, athletic or scientific; and
   (E)   At the time of making application for a roadway donation solicitation permit, applicants must furnish the following materials to the village in forms and types requested by the village:
      (1)   Proof of the applicant’s tax exempt status or other proof of the group’s status as a bona-fide not-for-profit organization;
      (2)   Proof of insurance coverage in forms and amounts sufficient to cover any injuries to personnel of the applicant who would conduct donation solicitation activities pursuant to the permit.
   (F)   All permits shall be limited to times no earlier than 8:00 a.m. and no later than 7:00 p.m., and shall be granted to the months of April through November.
