ADOPTING ORDINANCES

ORDINANCE NO. 2057 (2011)

AN ORDINANCE ADOPTING

THE VILLAGE CODE OF CRESTWOOD, ILLINOIS

   WHEREAS, the Village has previously undertaken a codification of the ordinances of the Village utilizing the services of American Legal Publishing Corporation of Cincinnati, Ohio, Copyright 2011; and

   WHEREAS, the aforesaid American Legal Publishing Corporation has rendered a codification book to the Village of the ordinances; and

   WHEREAS, the Village authorities, after reviewing the codification as presented, wish to approve the codification except as noted herein.

   NOW, THEREFORE, be it ordained by the Village Mayor and Board of Trustees of the Village of Crestwood, County of Cook, State of Illinois, an Illinois municipal corporation, as follows:

SECTION ONE

CODIFICATION ADOPTED

   From and after the date of passage of this Ordinance, the Village Code of the Village of Crestwood, prepared by American Legal Publishing Corporation, containing the compilation of ordinances as a general nature, together with changes made to the said ordinances under the direction of the governing body of the Village, shall be accepted in all courts without question as the official Code and law of the Village as enacted by the Mayor and Board of Trustees.

SECTION TWO

EXCEPTION TO CODIFICATION

   The Village may in the future identify scrivener's errors, which may be excepted from the Codification by future ordinances.

SECTION THREE

PERPETUAL CODIFICATION

   There is hereby adopted, as a method of perpetual codification, the loose-leaf type of binding, together with continuous supplement services provided by American Legal Publishing Corporation, or

such other code codifier printer chosen by the Village, whereby each newly adopted ordinance of a general and permanent nature amending, altering, adding or deleting provisions of the official Village Code is identified by proper catch line as inserted in the proper place in each of the Village copies, three copies of which shall be maintained in the office of the Village Clerk, certified as to the correctness and available for inspection at any and all times that the said office is regularly open. The Village Clerk is hereby authorized and may publish updates to the Code as supplied by American Legal Publishing Corporation on the Village website, as updated from time to time.

SECTION FOUR

ORDINANCES EXCLUDED FROM CODIFICATION

   All ordinances of a general nature included in this Village Code shall be considered as a continuation of said ordinance provision, and the fact that some provisions have been deliberately eliminated by the governing body shall not serve to cause any interruption in the continuous effectiveness of ordinances included in said Village Code. All ordinances of a special nature, such as tax levy ordinances, bond ordinances, franchise ordinances, annexation ordinances, vacation ordinances, special use ordinances and the like, shall remain in full force and effect unless specifically repealed or amended by provision of the Village Code. Such ordinances are not intended to be included in the Official Village Code.

SECTION FIVE

UNAUTHORIZED DELETIONS

   It shall be unlawful for any person, firm or corporation to change or amend, by additions or deletions, any portion of such Code, or to insert or delete pages or portions thereof, or to alter or tamper with such Code in any such manner which shall cause the law of the Village to be misrepresented thereby.

SECTION SIX

REPEAL CONFLICT OF CONFLICTING ORDINANCES

   Subject to the provisions of Section Four, all ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, repealed.

SECTION SEVEN

FULL FORCE AND EFFECT AFTER PASSAGE

   This Ordinance and the Code, adopted by this Ordinance shall be in full force and effect from and after its passage and approval in accordance with the law as printed and published in the book form by order of the Mayor and Board of Trustees.
