(A) Review by the Borough Engineer.
(1) The Borough Engineer shall review the final plan to determine its conformance to this chapter and the borough’s zoning regulations (Chapter 155 of this code of ordinances), as amended, identifying all deviations from the requirements of the said ordinances as may be found, and recommending such changes, alterations or modifications as he or she may deem necessary.
(2) The report of the Borough Engineer shall be in writing and shall be submitted to the Planning Commission at or prior to the meeting at which the preliminary plan is to be considered by the Planning Commission.
(B) Review by the Borough Planning Commission. The final plan shall be reviewed by the Borough Planning Commission in the same manner as stipulated for preliminary plans by § 154.033(B).
(C) Review by the Borough Council. The final plan shall be reviewed by Borough Council in the same manner as stipulated for preliminary plans by § 154.033(C).
(D) Required improvements. Prior to approval of the final plan, the applicant must guarantee the installation of all required improvements by one of the following methods:
(1) By installing said improvements to the satisfaction of the Borough Engineer. Upon completion, the Borough Engineer shall issue to the developer a certificate stating that all improvements have been installed in accordance with the standards and requirements of this and all other applicable borough regulations; and
(2) In lieu of completing all of the improvements required, the applicant may post financial security in the form of an improvements guarantee in accordance with the regulations of § 154.090.
(E) Decision. The decision of Borough Council shall be rendered no later than 90 days after the date of the regular Planning Commission meeting next following the date upon which the applicant has made a complete plan submission in accordance with this section. However, if the said regular Planning Commission meeting is more than 30 days after the submission date, the first day of the 90 days review period shall be the thirtieth day after a complete plan submission has been made by the applicant. This review period may be extended by mutual agreement of the applicant and the borough; such agreement shall be in writing.
(F) Action of borough. The action of borough shall be noted with the date President of Borough Council on Council to approve or deny the final plan of such action and the signature of the at least two sets of plans.
(1) If the final plan is denied, the minutes of the meeting and the written decision shall state the reasons for such determination, including the provisions of this chapter, the zoning regulations (Chapter 155 of this code of ordinances) or other borough ordinance, statute, regulation or code relied upon.
(2) If the final plan is approved, the President of Borough Council and sufficient members of both Council and the Borough Planning Commission to make a simple majority of each body shall sign and date as many paper prints of the approved plan as may be required for the recording process and for the administrative needs of the borough, the county and the applicant.
(G) Notice. Within one week of the meeting at which the final plan has been approved or denied, the Borough Manager shall send written notice of the findings, action taken and reasons therefor to the applicant and the Borough Planning Commission. If the final plan is disapproved, one copy of the plan shall be maintained for the permanent records of the township, and at least one copy shall be returned to the applicant.
