§ 72.04 AUTHORITY OF POLICE TO INSPECT VEHICLES.
   (A)   (1)   Any police officer having reason to believe that the height, length, width or weight of any motor truck, semi-trailer truck or trailer and load is unlawful, is authorized to require the driver to stop and submit to measurement and/or weighing of same. The driver of such vehicle shall, when necessary, be directed to proceed to a public scale to ascertain whether or not such vehicle exceeds the maximum weight limitation prescribed by state law or city ordinance.
      (2)   The weighing of the vehicle shall not be required if the public scales are at a distance of five miles or more from the point at which the vehicle is first directed to stop.
   (B)   In accordance with KRS 189.223, the refusal of the operator to permit his or her motor truck, semi- trailer truck or trailer to be measured or weighed, or to proceed to said public scales, shall constitute a violation of KRS Ch. 189 and this section.
