8-1-7: MAINTENANCE AND PROTECTION OF PUBLIC STREETS:
   A.   Driveways To Be Installed On All Construction Sites Prior To Any Other Building Activity: No construction shall be commenced upon any site (except for the construction required hereby) until there shall have been installed upon the full width and length of the proposed driveway, or other means of ingress and egress, the subsurface of such driveway or other means of ingress and egress.
   B.   Subsurface Material: Such subsurface shall be constructed in accordance with title 7, chapter 2 of this code.
   C.   Alternative To Immediate Driveway Installation, Approval Required: If there exist valid reasons why it would be impractical to construct the subsurface of a driveway or other means of ingress and egress along the length and width of the proposed driveway or other means of ingress or egress prior to other construction, the owner or contractor may, with the written approval of the building commissioner, construct a suitable means of ingress and egress at some other location across the construction site between the location of the proposed building or other improvement and the street or streets to be used for access to the construction site, which alternative route shall comply with the requirements of subsection B of this section. Approval of such alternative means shall be at the sole discretion of the building commissioner.
   D.   Removal Of Construction Site Debris From Streets Required 1 : It shall be unlawful for any person or other legal entity engaged in any construction work upon any construction site within the city to leave such site at the end of any day, during which construction work is carried on, without first having removed all debris from such construction site from all streets over which vehicles going to or from such site shall have passed.
   E.   Responsibility: It shall be the responsibility of the owner of any construction site and the general contractor, if any, to comply with the requirements of subsections A, B and C of this section, and either or both shall be subject to prosecution for violation thereof under subsection F of this section.
Further, it shall be the responsibility of any owner of a construction site, any general contractor, subcontractor and each of their agents, servants and employees, to comply with or cause the compliance with the requirements of subsection D of this section, and any or all of them shall be subject to prosecution for violation thereof under subsection F of this section.
   F.   Enforcement And Penalty: Any person or other legal entity who violates any provision of this section shall be fined not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00) for each offense. Each day a violation of this section shall continue shall be considered a separate violation.
In addition, the provisions of this section may be enforced by the city through its building commissioner, or other authorized agent, by injunction or temporary restraining order or other legal remedy. The city shall further have the right to seek civil damages for any violation of this section. (Ord. 10-20-0, 4-28-2010)
