3-3-9: THEATERS:
   A.   License Required: It shall be unlawful to give, present or conduct any motion picture or theatrical for which an admission fee is charged without having first secured a license therefor. (1970 Code §8-2.41)
   B.   Application For License: Application for such license shall be made in conformance with the general provisions relating to such applications set forth in section 3-1-2 of this title and shall state, in addition to the other information required, the place of the intended performance and the seating capacity thereof.    C.   Fees: See section 3-1-13 of this title. (Ord. 00-38-0, 12-13-2000)
   D.   Prohibited Acts Or Conditions: It shall be unlawful for any person to commit any of the following acts: (1970 Code §8-2.44)
      1.   Prohibited Pictures: To permit any person to offer or present any motion picture which has a tendency to cause a riot or public disturbance of the peace, or obscene picture or performance. (1970 Code §8-2.44; amd. Ord. 14-29-0, 8-27-2014)
      2.   Crowding, Order: To permit any person, excepting ushers or other theater employees, to remain standing in a hall or room in which a motion picture or theatrical is presented during the time of such performance; and to admit to any such hall more persons than can be accommodated by the seating arrangements of the premises. (1970 Code §8-2.46)
      3.   Scenery: To use in any theater any scenery other than nonflammable scenery or such as shall have been rendered nonflammable by the application of fire preventive coatings. (1970 Code §8-2.49)
      4.   Building Requirements: To present any public motion picture or theatrical in any building or structure which does not contain the number of exits required by the ordinances of the city or by statutes concerning buildings or places intended for such performances, or in premises which the electric wiring does not fully comply with the ordinances. All places used for the exhibition of motion pictures or theatricals must be kept adequately ventilated during the performance and for so long a time as the audience remains therein.       5.   Exits: To obstruct or permit the obstruction of any aisle, corridor or exit leading from any room or enclosure in which a motion picture performance or theatrical is being given or in which an audience for such a performance is seated. (1970 Code §8-2.51)
