4-4-5: REMOVAL PROCEDURES:
   A.   Order To Remove: Any officer of the county sheriff's department or member of the city council may order any junk vehicles, trailers, all types of machinery and equipment, or parts thereof and/or debris removed.
   B.   Failure To Remove; Penalty: It shall be unlawful and a misdemeanor for any person to fail or refuse to remove an unidentified, stolen, wrecked, abandoned or junk vehicle, trailer, all types of machinery and equipment, electrical appliances or parts thereof and/or debris or other personal property herein referred to, or refuse to abate such nuisance when ordered to do so in accordance with section 4-4-3 of this chapter. Violation of any of the above shall result in a penalty as provided in section 1-4-1 of this code per occurrence.
   C.   Removal By City; Costs: If said junk vehicles, trailers, all types of machinery and equipment, electrical appliances or parts thereof and/or debris are not removed after a responsible person has been instructed to remove the same, the county sheriff's department or the city may cause said junk vehicles, trailers, all types of machinery and equipment, electrical appliances or parts thereof and/or debris to be removed and the actual costs of removal or towing charge, and a penalty as provided in section 1-4-1 of this code per offense shall be charged. The procedure for ordering said removal shall be developed and maintained by the city. (Ord. 468, 6-8-2010; amd. 2015 Code)
