913.08 MINIMUM REQUIREMENTS FOR TEMPORARY STREETS.
   (a)   Residents abutting a street or residing in a subdivision may have installed, laid, and constructed at their own expense a surface for a temporary street, the minimum of three inches of T-35 asphalt street flexible pavement surfacing, as this conforms to the City’s specifications with respect to paving width in relation to rights of way.
   (b)   Where presently existing temporary streets within the City use this method of temporary surfacing, the paving widths may be changed to meet special conditions. Such changes shall be made only with the consent and approval of the Director of Public Safety and Service and the Street Committee of Council.
   (c)   If temporary surfacing to used, the intersections of streets so surfaced will be paid for by all of the abutting owners of the intersecting streets so surfaced on a pro-rata basis. Each abutting owner will pay for an equal share of the cost of constructing and laying the intersection or intersections. Any abutting property owners electing to use this method of temporary surfacing will assume permanent maintenance of the street and intersection. Permanent maintenance means resurfacing or replacement of the street. The responsibility of maintaining proper drainage of street surfaced by the temporary method shall be with the abutting owners of the street.
   (d)   Three-inch T-35 asphalt street flexible pavement surfacing shall be construed to mean a temporary surface and not a hard surface as set forth in Sections 913.05 and 913.06, and if streets are surfaced by the temporary method, no integral curbs and gutters will be permitted.
   (e)   If streets are surfaced by the temporary method, Sections 913.05 and 913.06 shall not be construed to conflict with this section. It is the intention herein to allow abutting property owners to have installed, laid, and constructed a temporary street as provided herein, or to construct a permanent street of Portland cement or asphaltic cement as presently provided in Sections 913.05 and 913.06.
