(A) Anyone violating the provisions of § 92.01 shall be subject to a penalty of $2 for the first violation and $5 for each succeeding violation.
(B) Any person who violates any provision of §§ 92.03—92.09 may incur a civil penalty to the town of up to $250. The first violation of §§ 92.03—92.09 shall subject the violator to a written warning, the second violation during a 12-month period shall subject the violator to a $50 penalty, the third violation during a 12-month period shall subject the violator to a $100 penalty, the fourth violation during a 12-month period shall subject the violator to a $150 penalty; and the fifth and any subsequent violation during a 12-month period shall subject the violator to a $250 penalty. In addition, a violation of §§ 92.03—92.09 shall constitute a misdemeanor punishable under the laws of the state.
(C) Any person who violates any provision of § 92.10 may incur a civil penalty to the town of up to $100. The first violation of § 92.10 shall subject the violator to a written warning; the second violation during a 12-month period shall subject the violator to a $50 penalty; and the third and any subsequent violation during a 12-month period shall subject the violator to a $100 penalty, plus revocation of the permit to keep chickens.
