959.06 CONDITIONS OF HAULING PERMIT.
   (a)   A City issued hauling permit shall be conditioned upon the following:
      (1)   The Contractor shall maintain an office in Ashtabula County, Ohio, or a contiguous County, and telephone service with a non-toll telephone number from the City, which shall be manned by a live operator and a supervisor on working days from 7:00 a.m. to 5:00 p.m. to receive any complaints or calls regarding the Collection Services from a Resident or the City. The Contractor shall also maintain an emergency contact number which is available 24 hours per day, seven (7) days per week.
      (2)    All vehicles used by the Contractor for the collection of Solid Waste or Recyclable Materials shall be enclosed, washed and cleaned, leak-proof (including but not limited to free from excessive leaks of fuel or hydraulic fluid), free of rust damage (including but not limited to holes or loose metal and equipped with a broom, shovel, rake, back-up alarm and warning lights visible in a 360 degree arc. All vehicles shall be painted, and shall bear the Contractor's name, vehicle number and Contractor's telephone number in a minimum of 4 inch lettering.
      (3)   The Contractor shall furnish to the City satisfactory proof that the Contractor has paid current premiums for workers' compensation coverage for all persons in its employment. The Contractor shall hold the City free and harmless for any and all personal injuries of all persons performing work for the Contractor under this Collection Agreement.
      (4)   Offer its customers a weekly curbside recycling program in accordance with this chapter. Each contractor shall provide the City, on a quarterly basis, the number of customers utilizing their recycling service and verification of the amount or weight of recyclables deposited with the facility named in its application.
      (5)   Other provisions and requirements set forth in this chapter.
      (6)   Compliance with all local, state and federal laws including income tax filings, workers' compensation, traffic laws, safety regulations and sanitation laws and regulations.
      (7)   A contractor collecting refuse in the City shall call for and remove refuse at least once each week Monday through Thursday in the City. No refuse collection shall be allowed on Saturday or Sunday unless due to a holiday observance or severe weather conditions. All of the collections shall be in a clean manner. Each contractor shall clean up materials within the right-of-way in front of the property. A contractor collecting refuse in the City shall offer as a service to pick up one heavy item each week such as but not limited to kitchen equipment (stoves, microwaves, dishwashers, refrigerators must have Freon removed and tagged, electronic equipment such as stereos, televisions, game tables, and/or similar items, interior furnishings such as chairs, couches, mattresses, box springs, and /or similar items).
      (8)   All garbage and rubbish collected in the manner herein defined shall be conveyed and disposed of by the contractor in a properly licensed landfill or dropped off at a properly licensed transfer station.
      (9)   No contractor shall pick up residential refuse in a district before 5:00 a.m. and no later than 6:00 p.m.
   (b)   The City Manager may revoke a license to haul trash upon thirty day written notice to the hauler of a violation of Section 959.05 or 959.06.
