12.2.503: MINIMUM CLEARANCE FROM ELECTRIC FACILITIES:
A clear zone as specified by the Electric Services Standards Manual around electric facilities (pad-mounted equipment, vaults, poles, etc.) shall be maintained. Utilities has the right to remove any obstructions found within the specified clear zone. (Ord. 98-173; Ord. 01-42)
12.2.504: UNDERGROUND FACILITIES:
It shall not be permissible for any person to modify the grade of the earth on any easement or rights-of-way without the written approval of the Chief Executive Officer. (Ord. 98-173; Ord. 01-42; Ord. 18-42)

12.2.601: Statement Of Limitations
12.2.602: Authorization For Use Of Utility Poles
12.2.601: STATEMENT OF LIMITATIONS:
   A.   The provisions in this part govern the attachments and the use of utility poles maintained and/or controlled by Utilities.
   B.   This part applies only to pole attachments used for the installation of transmission and distribution lines and any apparatus related or incidental thereto by a person that is not a utility and not a cable television system.
   C.   Nothing in this part shall be deemed to govern the installation of cable television facilities on utility poles or to govern the use of utility poles by another utility pursuant to agreement between the City or Utilities and that utility. (Ord. 98-173; Ord. 01-42)
12.2.602: AUTHORIZATION FOR USE OF UTILITY POLES:
   A.   The Chief Executive Officer is authorized to enter into an agreement with any pole user for use of utility poles located in the streets, public rights-of-way, or utility easements of the City or Utilities. Use of the poles shall be in compliance with any agreement entered into between the Chief Executive Officer and the pole user. Use of the pole shall also be in accord with any rules and regulations which may be promulgated by the Chief Executive Officer pursuant to the provisions of this chapter and any applicable provisions of this Code or any subsequent amendments thereto.
   B.   The provisions of this section shall not be deemed to authorize any person subject to this section to place an attachment upon the utility poles until the time as the person has entered into an agreement as authorized by this section.
   C.   The agreement shall set forth the terms, conditions and charges under which the pole user uses utility poles. No exclusive use of utility poles shall be created pursuant to any agreement entered into pursuant to this section. The Utilities reserves the right to terminate any agreement upon reasonable notice as specified in the terms of the agreement and reserves the right to limit any subsequent attachments to the poles.
