12.2.201: DEFINITIONS:
Unless the context specifically indicates otherwise, the following terms, as used in this article, shall have the meanings hereinafter designated:
ARTICLE OR THIS ARTICLE: Chapter 12, article 2 of this Code of the City of Colorado Springs.
COGENERATOR OR QUALIFIED SMALL POWER PRODUCER: Any person or entity who is constructing or developing an electric generating system who wishes to connect the generating system to the electric system for the purpose of selling electricity to the Utilities or to other persons or entities.
DISTRIBUTION FACILITIES: Distribution lines and/or service lines and appurtenances thereto.
DISTRIBUTION LINE: A line capable of conducting electricity which is used for the purpose of general distribution of electricity to users, extending from the substations up to, but not including, the service line.
ELECTRIC POLE: The vertical pole or other structure used to support overhead electric lines, transformers or other electrical facilities.
ELECTRIC SERVICE STANDARDS MANUAL: A publication revised and published as needed by the Electric Department which contains the applicable policies, rules and regulations. This manual is available at no charge at designated offices of the Utilities.
NEC: The National Electrical Code as adopted by the National Fire Protection Association (NFPA).
NESC: The National Electrical Safety Code as adopted by the American National Standards Institute (ANSI).
PRODUCTION SYSTEM: That portion of the electric supply system of the City which is used primarily for the generation or production of electrical energy, including electric generation plants and their appurtenances up to, but not including, substations.
SERVICE LINE: A distribution facility which conducts electricity from distribution lines to users and which extends from the distribution line to the point of connection on the building or other structure of the user, including the connection.
TRANSMISSION AND DISTRIBUTION SYSTEM: That portion of the electric supply system which is used primarily for the transmission of electricity between substations or transformers or for the distribution of electricity to users, from and including substations which receive electricity from electric generation plants. The system shall also include service lines, transmission lines and distribution lines.
TRANSMISSION LINE: A line capable of conducting electricity which is used for the purpose of transmitting electricity from electric generation plants to substations for transformation or distribution, or between the substations and all appurtenances thereto.
USER: Any person who uses, takes electricity from, or is connected to the electric supply system, except as expressly provided otherwise by contract with Utilities. (Ord. 98-173; Ord. 01-42)
12.2.202: PRIORITY OF REGULATIONS:
   A.   The use or connection to the electric supply system of the City by any person shall be subject to one or more of the following as applicable:
      1.   All ordinances and resolutions of the City;
      2.   The provisions of the currently effective tariff sheets governing electric service for the various classes, including regulations set forth herein;
      3.   Applicable provisions of the National Electric Safety Code as modified and adopted by the Utilities and the most current edition of relevant service standards and specifications;
      4.   Applicable provisions of the National Electric Code as adopted by Council in the Regional Building Code.
   B.   In the event of any inconsistency or conflict among or between any of the foregoing sources of regulation, precedence shall be given in the order in which the sources of regulation are set out herein.
   C.   Where the PUC retains jurisdiction of a utility matter, applicable decisions or rules of the PUC shall take precedence over the sources of regulations set out herein. (Ord. 98-173; Ord. 01-42)
12.2.203: EXCAVATION FOR SERVICE 1 :
All excavations for electric service installation or repair shall be performed in accord with this Code and the electric service standards manual as applicable. The excavations shall meet all applicable safety standards, including any requirements as to barricades and lights. Streets, sidewalks, parkways and other public property disturbed in the course of work shall be restored in a manner satisfactory to the Department of Public Works of the City. 12.2.204: SECURITY LIGHTING:
Utilities may install an exterior light fixture on an existing electric pole in an existing easement of the City for the purpose of security lighting in accord with policy set forth in the electric service standards manual. (Ord. 98-173; Ord. 01-42)

12.2.301: CONNECTION TO SYSTEM:
   A.   It shall be unlawful for the owner, lessor, or occupant of any premises within the City to accept service from any electric utility other than Utilities without the express, written consent of the Chief Executive Officer, unless the premises are being so served either on the effective date hereof or at the time of annexation by the City, or without the express provision thereof by an approved annexation agreement.
   B.   The owner or developer of the premises shall notify Utilities when the premises are ready for connection to the electric supply system of the City. No premises shall be supplied with permanent electricity from the electric supply system unless the same shall be designated by official street name and number and the official number shall be placed and maintained conspicuously thereon in accord with the addressing requirements of this Code, and in particular, Building Code provisions pertaining to enumeration. Connections of the premises shall only be performed upon approval by Utilities. Neither the City nor Utilities shall be subjected to any liability for any deficiency or defect which is not discovered by inspection nor shall the owner or developer of the premises be absolved from liability for the deficiency or defect and any resulting damage or from responsibility to correct the deficiency or defect. 12.2.302: TRANSMISSION AND DISTRIBUTION LINES; INSTALLATION:
   A.   Except as otherwise provided in this article, transmission and/or distribution lines shall be installed by means of overhead wires.
   B.   The Chief Executive Officer shall determine the location, direction, type and capacity of all transmission and/or distribution lines. Easements or rights-of-way may be required where deemed necessary by the Chief Executive Officer to ensure the safety or efficiency of the operation or maintenance of the transmission or distribution system. 12.2.303: DISTRIBUTION LINES; UNDERGROUND:
An underground distribution line shall be installed to a new area, addition, development or subdivision requiring underground utilities as designated by the City and/or the County Planning Commission or as required by this Code, or upon request of the owner or developer of the area, addition, development or subdivision. 12.2.304: ELECTRIC DISTRIBUTION FACILITIES; COMPLIANCE WITH SUBDIVISION REQUIREMENTS 1 :
No electric distribution facilities shall be laid, placed or installed in any proposed addition or subdivision within the City for service thereto until the addition or subdivision is platted and approved in accord with chapter 7 of this Code; except the Chief Executive Officer may approve the installation of electric facilities after final approval of the final plat, but prior to the recording of the plat, upon the request of the owner subject to an agreement as prescribed by the Chief Executive Officer.
