In case of need, the Chief of Police is authorized to call into duty any or all reserve police officers. Reserve police officers are authorized and empowered to perform these duties as deemed necessary by the Chief of Police and governed by the provisions of Colorado Revised Statutes section 18-1-901(3)(l)(IV.5). A. When called into duty, reserve police officers shall be under the direction of the Chief of Police and other officers of the Police Department and shall be subject to all discipline, rules and regulations applicable to paid regular police officers and all special rules and regulations for reserve police.
B. No reserve police officer shall, while on duty, wilfully disobey any rules or regulations, concerning the unit, or any proper order of the Chief of Police or any other police officer having authority over the reserve police officer. (1968 Code §§7-36, 7-39; Ord. 77-78; Ord. 94-63; Ord. 01-42)
Upon issuance of a State of Colorado POST certification, each reserve police officer shall take an oath to support the Constitution of the United States and the Constitution of the State of Colorado and the Charter of the City of Colorado Springs, and to faithfully perform the duties and assignments of a reserve police officer 1 . Any reserve police officer may resign upon giving the Chief of Police forty eight (48) hours' notice in writing of the reserve officer's intention, and the Chief of Police may remove any reserve police officer at any time without cause, without notice and without appeal. (1968 Code §7-37; Ord. 77-78; Ord. 94-63; Ord. 01-42)
Uniforms and equipment deemed necessary by the Chief of Police to fulfill the duties and responsibility of a reserve police officer shall be required. Equipment not provided by the Police Department will be purchased and maintained at the reserve police officer's own expense. In addition, each reserve police officer shall wear a badge and patches signifying the fact that the officer is a reserve police officer. All badges, patches, identification cards and issued uniforms and equipment shall remain the property of the Police Department. (Ord. 94-63; Ord. 01-42)
There is hereby established the City Marshal's Office, which shall consist of a supervisory police officer, and a number of marshals as the Mayor deems necessary for the efficient operation of the office. The City Marshal's Office and all employees are assigned to the Office of the Chief of Police. Marshals are not considered "Uniformed Members" of the Police Department for the purpose of sections 8.1.102, 8.1.105 and 8.1.201 of this article. However, all marshals are subject to any Police Department rules, regulations and orders that are applicable to them pursuant to section 8.1.105 of this article. (Ord. 84-83; Ord. 01-42; Ord. 11-19)
