3-1-9: BUSINESSES INVOLVING NUDITY PROHIBITED:

   A.   It shall be cause for revocation or suspension of a business license and/or liquor license issued by the city if a licensee, his manager or agent shall allow any live person to appear or have reasonable cause to believe that any live person shall appear in any licensed premises in a state of nudity to: provide entertainment; provide service; act as hostess, manager or owner, or to serve as an employee in any capacity.

   B.   This section shall additionally include any establishment or business operating within the city whether they be licensed or not.

   C.   For the purposes of this section, the term "nudity" shall mean the showing of human male or female genitals, pubic area or buttocks, or the female breast including the nipple or any portion below the nipple with less than a full opaque covering. Each live person appearing in any establishment or business is a separate offense.

   D.   In addition to suspension or revocation of any business and/or liquor license 1 as set forth in subsections A and B of this section, the business violating subsections A and B of this section shall be subject to penalty as provided in section 1-4-1 of this code. (Ord. 99-07, 7-26-1999)
