For the purposes of this chapter and Part Thirteen of these Codified Ordinances, the following terms, phrases, words and their derivations shall have the meanings given herein. When not inconsistent with the context, words used in the present tense include the future, words used in the singular number include the plural number, and words used in the plural number include the singular number. The word "shall" is always mandatory and not merely directory.

(a) "Commercial handbill" means any printed or written matter, any sample or device, dodger, circular, leaflet, pamphlet, paper, booklet or any other printed or otherwise reproduced original or copies of any matter or literature:
(1) Which advertises for sale any merchandise, product, commodity or thing;
(2) Which directs attention to any business or mercantile or commercial establishment, or other activity, for the purpose of either directly or indirectly promoting the interest thereof by sales;
(3) Which directs attention to or advertises any meeting, theatrical performance, exhibition or event of any kind, for which an admission fee is charged for the purpose of private gain or profit.
(b) "Noncommercial handbill" means printed or written matter, any sample or device, dodger, circular, leaflet, pamphlet, newspaper, magazine, paper, booklet, or any other printed or otherwise reproduced original or copies of any matter of literature not included in the aforesaid definition of "commercial handbill".
(c) "Garbage" means putrescible animal, fish, fowl, fruit or vegetable waste resulting from the handling, preparation, cooking, consumption and storage of food.
(d) "Rubbish" means nonputrescible solid waste consisting of both combustible and noncombustible waste, such as paper, wrappings, dirt, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass, bedding, crockery and similar materials.
(e) "Refuse" means all putrescible and nonputrescible waste, including garbage, rubbish, ashes, street cleanings, dead animals, abandoned automobiles, market and industrial waste, trash, junk or similar substance or material.
(f) "Litter" means garbage, refuse and rubbish, as defined herein, and all other waste matter which, if thrown or deposited as herein prohibited, tends to depreciate property values or may create a nuisance or a danger to public health, safety and welfare.
(g) "Public property" means all property owned, operated or controlled by any governmental agency, including, but not limited to, streets, sidewalks, tree lawns, parks, playgrounds, parking lots, schools, libraries, post offices, municipal transit facilities, and all other public lands and buildings.
(h) "Private property" means all property not included in the aforesaid definition of public property, including, but not limited to, vacant land or any land, building or other structure designed or used for residential, commercial, business, industrial, institutional or religious purposes, together with any yard, grounds, walk, driveway, fence, porch, steps, vestibule, mailbox and other structure appurtenant thereto.
(i) "Park" means a park, playground, playfield, recreation center or any other public property in the City devoted to active or passive recreation.
(j) "Vehicle" means every device in, upon or by which any person or property is or may be transported or drawn upon a highway.
(k) "Construction site" means any private or public property upon which repairs to existing buildings, construction of new buildings, or demolition of existing buildings is taking place.
(l) "Person" means any person, firm, partnership, association, corporation, company or organization of any kind.
(m) "Public receptacles" means any receptacles provided by or authorized by the City.
