1345.021 LICENSE TO ENTER ADJOINING PROPERTY.
   (a)   For the purposes of performing repairs, alteration or maintenance of any dwelling, building or other structure, on the interior or exterior thereof, and as necessary to effect compliance with the City's Building and Housing Codes and any other City ordinances, or rules adopted or orders issued pursuant thereto, a property owner or his agent shall request from the adjoining property owner the necessary permission to enter upon the adjoining property for the purpose of making such improvements. If such permission is refused, the property owner shall contact the Building Commissioner and make known his desire to make such specific repairs or improvements. The Commissioner or his designee shall then conduct an investigation into the necessity of entering onto the adjoining property for the purpose of making such improvements. Such investigation shall include discussions with the adjoining property owner involved as to why permission has been denied. The Commissioner shall make a written report of his findings concerning the requested permit.
   (b)   The Commissioner shall then issue or deny a permit authorizing the entrance upon the adjoining property for the purposes of making the improvements described in the application for the permit. Should the Commissioner determine to grant such requested permit for the purposes requested, the permit issued shall specify the time when the improvements shall be made and any other conditions relevant to the work to be accomplished. The Commissioner shall advise the adjoining property owner of the issuance of any such permit.
   (c)   The licensee shall have the obligation to perform the work authorized at such time and in the manner described in the permit so that the rights of the owner of the adjoining premises are protected, and such licensee shall be obligated to correct any damage done to the adjoining premises as a result of the accomplishment of the work, and shall restore the adjoining property owner's premises to the same condition as when he entered thereon.
   (d)   The Commissioner shall provide forms for an application for this permit. A fee of twenty dollars ($20.00) for this permit shall accompany the application filed pursuant to the provisions of this section.
