(a) There is hereby created in this City a Fair Practices Board with membership appointed by Council and as follows:
(1) Three (3) residents of the City meeting the qualifications set forth in this Section; and
(2) One (1) alternate member having the qualifications set forth in this Section.
(b) Of the members first appointed, one (l) shall hold office for a term of one (1) year; one (1) for a term of two (2) years; and the other for a term of three (3) years; and their successors shall be appointed for terms of three (3) years. Council shall fill all vacancies by appointment for the unexpired term. A Board member or alternate whose term has expired shall be eligible for reappointment to the Board. However, any Board member or alternate may serve a maximum of two (2) complete terms. Board members presently serving on this Board shall continue their service thereon until expiration of his or her current term of office.
(c) The Board shall serve without salary.
(d) If an individual Board member has a preexisting personal or professional relationship with a Complainant, Aggrieved Person, or Respondent, that Board member shall recuse himself or herself on all matters concerning said Person. In case of an absence or recusal of any Board member for any reason, the Complaint Officer shall request the attendance of the alternate to serve in the place of the absent or recused member so that three (3) Board members are present at every meeting whenever possible.
(f) Two (2) members of the Board shall constitute a quorum for the purpose of conducting the business thereof. Action by the Board on any matter shall be effected by the concurring votes of at least two (2) members. A vacancy on the Board shall not impair the right of the other members to exercise all the powers of the Board.
(g) The Board may adopt rules and regulations for the conduct of its business, subject to approval by the Director of Law.
(h) Council may, from time to time, request a written report from the Board of its activities and any recommendations including, but not limited to, educational and other programs designed to promote the purposes stated in this Chapter.
