After such emergency has been declared, any motorist whose vehicle is found parked or becomes stalled by reason of failure to have it properly equipped with the safety devices as hereinbefore described shall be subject to the penalty prescribed by Section 303.99. In addition, where a vehicle is towed the vehicle can be recovered only upon the payment of the towing and storage charges imposed.
