AN ORDINANCE ADOPTING THE REVISED ORDINANCES OF THE CITY OF CHILLICOTHE, OHIO, 1961, PROVIDING FOR PUBLICATION AT LENGTH IN A CODE OF REVISED ORDINANCES AS PROVIDED IN SECTION 731.23 OF THE OHIO REVISED CODE AND SECTION 2.19 (2) OF THE CHARTER OF CHILLICOTHE, OHIO, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THE REVISED ORDINANCES OF THE CITY OF CHILLICOTHE, OHIO, 1961, AND PROVIDING FOR THE COMPILATION INTO PARTS, TITLES, CHAPTERS, TO BE KNOWN AS (1) THE ADMINISTRATIVE CODE, (3) THE TRAFFIC CODE, (5) THE GENERAL OFFENSES CODE, (7) BUSINESS REGULATION CODE, (9) STREETS AND PUBLIC SERVICES CODE, (11) PLANNING AND ZONING CODE, (13) BUILDING CODE AND (15) FIRE PREVENTION CODE.
WHEREAS, the Council of the City of Chillicothe, Ohio has had the matter of codification and general revision of the ordinances before it for some time, and,
WHEREAS, it has heretofore entered into a contract with The Walter H. Drane Company to publish said codification and,
WHEREAS, the codification of said ordinances, together with the new matter to be adopted, the matters to be amended and those sections to be repealed are before the Council, NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CHILLICOTHE, OHIO:
SECTION 1. Under the provisions of Section 2.19 (2) of the City Charter, the general and permanent ordinances of Chillicothe, Ohio, as amended, are hereby revised, rearranged, compiled, renumerated as to sections and codified into parts, titles and chapters designated by odd numbers respectively:

Be and the same are hereby adopted.
SECTION 2. The general and permanent ordinances of Chillicothe, Ohio, so revised, rearranged, compiled, renumbered as to sections and codified by The Walter H. Drane Company, are hereby approved and adopted as printed and published in book form in the manner approved by Council as the "Revised ordinances of the City of Chillicothe, Ohio, 1961" and as published and assembled in book form and certified as correct by the Mayor and the Clerk, shall be admitted in evidence and accepted by the courts and all persons as to the existence, effectiveness and regularity of all enactments so published in such book form as of the effective date of the Revised ordinances of the City of Chillicothe, Ohio, 1961. One copy of the Revised Ordinances of the City of Chillicothe, Ohio, 1961, upon certification as to correctness thereof in book form by the Mayor and the Clerk, shall be attached to this ordinance as part hereof and filed with the permanent ordinance records.
SECTION 3. All of the provisions of the Revised Ordinances of the City of Chillicothe, Ohio, 1961, shall be in force and effect at, on and after July 1, 1961 and the 1949 Code and all ordinances in force on the date of the passage of this ordinance in conflict with the Revised Ordinance of the City of Chillicothe, Ohio, 1961, are hereby repealed from and after July 1, 1961.
However, such repeal shall not affect:
(1) Any offense or act committed or done, or any penalty or forfeiture incurred, or any contract or right established or accruing before July 1, 1961.
(2) Any ordinance or resolution promising or guaranteeing the payment of money by or to the City, or authorizing the issuance of any bonds of the City, or any evidence of the City's indebtedness, or any contract or obligation assumed by the City.
(3) The administrative ordinances or resolutions of Council not in conflict or inconsistent with the provisions of the revised ordinances.
(4) Any right or franchise conferred by any ordinance or resolution of Council on any person or corporation.
(5) Any ordinance naming, relocating or vacating any street or public way.
(6) Any ordinance or part thereof providing for salaries or compensation.
(7) Any prosecution, suit or other proceeding pending, or any judgment rendered on or prior to July 1, 1961.
(8) Any ordinance or resolution which may be adopted by Council after January 1, 1961.
(9) Zoning Ordinance 1915-49, as amended.
SECTION 4. Wherever in the 1949 Code or in ordinances subsequent thereto up to an including November 17, 1958 the designation of certain officials has been changed in the Revised ordinances of the City of Chillicothe, Ohio, 1961, in order to comply with the provisions of the City Charter, as follows: (1) Mayor to City Manager; (2) Auditor and/or Treasurer to Director of Finance; and (3) Solicitor to Director of Law; the new title or designation shall control.
SECTION 5. The ordinances including the Revised Ordinances of the City of Chillicothe, ohio, 1961, have all heretofore been duly adopted and published as provided by law, or as provided by Section 2.18 and 2.19 of the Charter of the City of Chillicothe, Ohio, except the following titles, chapters and sections of which notice of inclusion in the Revised Ordinances of the City of Chillicothe, Ohio, 1961, is hereby given in accordance with Section 2.19 (2) of the City Charter, to wit:

SECTION 6. This ordinance shall take effect and be in force from and after its passage and approval by the Mayor and the earliest period allowed by law.
