(a) Scope and Purpose. The objective of this section is to set forth uniform requirements and guidelines for preventing the introduction and accumulation of fats, oils, and greases into the municipal wastewater system that will cause or contribute to sanitary sewer blockages and obstructions. Food Service Establishments (FSE) and other industrial or commercial establishments generating wastewater containing fats, oils, and greases are subject to this chapter. This section will regulate such uses by requiring that grease interceptors and other approved strategies be installed, implemented and maintained in accordance with the provisions within.
(b) Grease Interceptor Installation.
(1) Following the effective date of this section, all new FSE facilities operating within the City of Chillicothe, Ohio shall have grease interceptors. These interceptors will comply with the requirements of Chapter 9 (4101:2-56-69 OAC).
(2) Any FSE in operation on or before the effective date of this section, or for a period of 90 days prior thereto or for which a building permit has been purchased, approved and is currently under construction and is without a grease interceptor, shall be required to install a grease interceptor at the time of facility renovation, change of ownership, or within two years of the adoption of this ordinance, whichever comes first.
(3) Any new grease interceptor installation must obtain a Permit-To-Install (PTI) from the Ohio EPA prior to construction, unless the new installation meets an exemption from the PTI rule as specified in (OAC 3745-42-02).
(4) New grease interceptor installations shall include a sampling manhole. The sampling manhole will be placed as close to the discharge side of the interceptor as practical. The design, location, and proposed installation site shall be reviewed and approved by the Authority.
(5) Grease interceptors may be required in non-cooking establishments, cold dairy and frozen food product establishments, and other industrial or commercial establishments when the establishments generate wastewater containing fats, oils or grease, and the Authority determines that an interceptor is necessary to prevent contributions or accumulations of grease to the sanitary sewer collection and treatment systems.
(c) General Maintenance and Operations.
(1) Wastewater discharged to the FSE grease interceptors shall not exceed 100 degrees Fahrenheit at the point of entrance to the interceptor. Grease concentrations shall not exceed 75 mg/1 at a sampling point located nearest the interceptor's discharge to the sanitary sewer. Compliances with this discharge limit shall be determined by laboratory analysis. (EPA Hexane Extraction Method HEM 1664).
(2) Grease interceptors shall be serviced and emptied of accumulated waste content as required to maintain minimum design capacity or the effective volume of the grease interceptor. At no time shall the frequency of service exceed 90 days or as allowed by a valid FOG program modification, as defined in Section 911.16.32
(e). Users who are required to install grease interceptor shall:
A. Install and maintain a grease interceptor that complies with (Chapter 4101:2-56-69 OAC).
B. Grease interceptors shall be kept free of inorganic solid materials such as grit, rocks, gravel, sand, eating utensils, cigarettes, towels, and rags etc., which could settle into the soils blanket and there by reduce the effective volume of the grease interceptor.
C. Operate and maintain the grease interceptor to achieve and maintain an applicable action level. Applicable shall mean the compliance with any regulatory narrative or numeric value establish by the Authority.
(3) Contracted service providers maintaining grease interceptors within the City of Chillicothe, Ohio, shall be registered with the Ross County Department of Environmental Health, and obtain a permit from the Authority.
(4) When servicing grease interceptors within the City of Chillicothe, Ohio, all service providers must have, in their possession, the proper permit as issued by the Authority.
(5) The use of biological or other additives as grease degradation or conditioning agents is permissible only upon prior written permission granted by the Authority.
(6) The User shall maintain a written record on the current form issued by the Authority, of all grease interceptor maintenance for three years. All such records must be available for inspection by the Authority at all times. These records shall include:
A. FSE name and physical location
B. Date of grease interceptor service
C. Time of grease interceptor service
D. Name of contract service provider company
E. Name and signature of service provider company representative
F. The establish frequency of the service and the type of service provided
G. The number, location and size of each interceptor serviced
H. The total volume removed from each interceptor
I. Destination of waste, foods, solid and wastewater removed for disposal.
J. The date and signature of FSE personnel confirming service completion.
K. Any additional information that may be required by the Authority.
(7) No flow discharge from non-grease laden surfaces may be connected to sewer lines intended for the grease interceptor.
(8) FSE will incorporate, where applicable, BMPs into their kitchen management strategy to reduce the occurrence of FOG discharges to the sanitary sewer system.
(9) The owner of the property on which the common grease interceptor has been installed shall be primarily responsible for the maintenance, upkeep and repair of the common interceptor.
(d) Cost Recovery. Any User who discharges or places into the City of Chillicothe, Ohio sanitary sewer system any substance or material that causes a partial or total obstruction or blockage is required to reimburse the City of Chillicothe, Ohio for any costs incurred in responding to the obstruction or blockage, and any cost mitigating any damage to the City of Chillicothe, Ohio sanitary sewer system. The cost may be pro-rated to more than one User if more than one User contributed to the obstruction or blockage.
A User who knowingly violates this section may be subject enforcement action, and civil penalties as allowed by Section 911.99
.
(e) Request for Modification. The User may request a modification to the following requirements of this section.
(2) Grease interceptor maintenance schedule, and service procedures as defined in Section 911.16.32
(c)(2).
Requests for these modifications shall be made in written form to the Authority.
(f) Severability. If a court of competent jurisdiction invalidates any provisions in this section the remaining provisions will not be affected and will remain in force and effect.
(g) Conflict. All other ordinances and parts of ordinances inconsistent with any part of this section are hereby repealed to the extent of such inconsistency.
