(a) Appointment of Members; Divisions. There is created within the Department of Public Safety an auxiliary police unit, the members of which shall be appointed by the Safety- Service Director. The auxiliary police unit shall consist of two divisions known as the Nuisance Property Code Enforcement Division and the Law Enforcement Division.
(b) Term of Service. Auxiliary police officers shall serve at the pleasure of the Safety-Service Director, or until a resignation by any such member is accepted by the Safety-Service Director.
(c) Qualification of Members. The members of the auxiliary police unit shall not be under the age of twenty-one years at the time of their appointment, and shall meet such other requirements as provided by the rules adopted under subsection (e) hereof or applicable Ohio law. In addition, all members of the Law Enforcement Division within the auxiliary police unit must be certified by the State of Ohio as a peace officer. A member of the Law Enforcement Division may also serve as a member of the Nuisance Property Code Enforcement Division, however a member of the Nuisance Property Code Enforcement Division shall not serve as a member of the Law Enforcement Division absent certification by the State of Ohio as a peace officer as set forth herein.
(d) Control of Unit. The Chief of Police shall be the commanding officer of the auxiliary police unit, and shall have control of the assignment, training, stationing, and the direction of work of such unit. A member of the auxiliary police unit shall act only when in the prescribed uniform or partial uniform. Such auxiliary member shall obey the chain of command of the Police Department and shall take orders from all regularly appointed members thereof.
(e) Rules. The Safety-Service Director shall prescribe rules for the organization, administration, conduct, and control of the auxiliary police unit, subject to any rules prescribed by ordinance by the Council for the City of Chillicothe.
(f) Uniform. The Safety-Service Director is authorized to prescribe the type of uniform or partial uniform to be worn by members of the auxiliary police unit. The Chief of Police shall prescribe the times and places where the same shall be worn.
(g) Law Enforcement Division.
(1) The Law Enforcement Division of the auxiliary police unit may have no more than ten (10) members. All members of the Law Enforcement Division will have all police powers necessary, but shall perform only such duties as are assigned by the Chief of Police.
(2) Service on voluntary basis; classification; compensation.
A. All services performed by auxiliary police officers within the Law Enforcement Division shall be on a voluntary basis.
B. Members within the Law Enforcement Division of the auxiliary police unit shall not be in the classified service of the City.
C. Members within the Law Enforcement Division of the auxiliary police unit shall be paid $1 annually.

(h) Nuisance Property Code Enforcement Division.
(1) The Nuisance Property Code Enforcement Division of the auxiliary police unit shall have no more than one (1) member. The member will have all police powers necessary to ensure proper nuisance property code enforcement, including the power to enforce the provisions set forth in Chapter 1709 of the Revised Ordinances of the City of Chillicothe, but shall perform only such duties as are assigned by the Chief of Police.
(2) Nuisance Officer.
A. The auxiliary police officer within the Nuisance Property Code Enforcement Division shall serve as a full-time (40 hours per week) employee. Such position shall be in the unclassified service and shall be entitled to all fringe benefits. The Nuisance Officer shall be paid biweekly under the hours authorized and the hourly rate set by ordinance.

(i) Non-Liability. This section is declared to be for the protection of public peace, health, property, safety, and general welfare, and neither the City nor any agent or representative of the City, any officer appointed under this section, or any individual, firm, partnership, corporation, or the receiver or trustee or any other agent thereof, who in good faith executes any executive order or rule promulgated pursuant to this section shall be liable for injury to damage sustained as the direct or proximate result of such action.
