553.04 SPEED OF TRAINS.
   (a)    The rate of speed of running all locomotives and railroad cars upon railroad tracks within the corporate limits, shall be regulated at a speed not greater than twenty miles per hour in the business or closely built-up portions of the City and thirty-five miles per hour in all other portions of the City.

   (b)    In case or in the event that any conductor, engineer or company shall violate any of the provisions of Section 553.04, the City Solicitor is authorized and empowered to proceed by civil action to recover against such conductor, engineer or company, as provided in Ohio R.C. 723.48, a sum not less than five dollars ($5.00) nor more than fifty dollars ($50.00) for such offense.
