3-1-4: LICENSE CLASSIFICATIONS:
Retailer's licenses shall be divided into five (5) classes as follows:
CLASS A: Class A licenses shall authorize the retail sale of "alcoholic beverages", as defined in section 3-1-1 of this chapter, on the premises specified for consumption on such premises as well as other retail sales of such alcoholic beverages.
CLASS B: Class B licenses shall authorize the sale of "alcoholic beverages", as defined in section 3-1-1 of this chapter, on the premises specified in packages or original containers unopened, at retail, not to be consumed on such premises where sold.
CLASS C: Class C licenses shall authorize the retail sale of "beer" or "wine", as defined in section 3-1-1 of this chapter, on the premises specified for consumption on such premises only.
CLASS D: Class D licenses shall authorize the retail sale of "beer" or "wine", as defined in this chapter, on the site specified for consumption on such site in connection with a special event of no more than two (2) days held by a special event retailer. Such licenses shall be issued only to said special event retailer.
CLASS E: Class E licenses shall authorize the sale of "alcoholic beverages", as defined in section 3-1-1 of this chapter, on the premises specified in packages or original containers unopened, not to be consumed on such premises where sold. Provided however, this license shall also allow for consumption of "beer" and "wine" on the premises limited to a restricted area where: a) that restricted area contains a legitimate video gaming terminal or terminals as defined by 230 Illinois Compiled Statutes 40/5 of the Illinois "video gaming act", b) the restricted area is restricted to persons over the age of twenty one (21) years, c) the restricted area is actively and openly monitored on a consistent and continuing basis by at least one employee of the licensee who is over the age of twenty one (21) (a security camera or other monitoring camera does not qualify as monitoring of the restricted area), d) sale for consumption of beer and wine in the restricted area on the premises shall only be made incidental to the use of the video gaming terminals in the restricted area and not merely for general consumption within the restricted area, e) the license holder must install a door, partition or gate (not rope or similar barrier) to impede entry to the restricted area, but the barrier must not visually obscure the entrance to the gaming area from the employee charged with monitoring it, f) all video gaming terminals must be located in an area that is not readily visible from outside the establishment, and g) video gaming terminals may only be used during the hours of sale or consumption as set forth in subsection 3-1-8B of this chapter.
SPECIAL EVENT RETAILERS: A special event retailer's license shall permit the licensee to purchase beer from an Illinois licensed distributor, and shall allow the licensee to sell and offer for sale, at retail, beer for use or consumption, but not for resale in any form, and only at the location in the license. An applicant for a special event retailer license must also submit with the application proof satisfactory to the city council that the applicant will provide dramshop liability insurance in the limits set forth in subsection 3-1-6B6 of this chapter. A special event retailer's license shall be issued for a specific time period, not to exceed fifteen (15) days per licensee in any twelve (12) month period.
All holders of a special event retailer's license will be required to enforce the applicable social distancing mandates, including face masks for staff, and other requirements that may be set forth from time to time by the Illinois Department of Public Health.
