§ 153.04 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   APPROVED. Wherever the word APPROVED or APPROVAL appears in these regulations, with respect to a requisite to permission, it shall mean by the city’s Plan Commission, or its representative having authority granted herein, or elsewhere, by ordinance.
   BOARD OF APPEALS. The city’s Board of Zoning Appeals.
   BUILDING SET-BACK LINE. A line within a lot or other parcel of land (so designated on the plat of a proposed subdivision) between which line and the property or boundary line of the adjoining roadway where the erection of any part of a structure is prohibited.
   COMMISSION. The Plan Commission of the city.
   CONSTRUCTION PLANS. Detailed drawings conforming to the requirements of §§ 153.06, 153.25 through 153.32 and 153.45 of this code.
   DEAD-END ROADWAY. A roadway having but one outlet for vehicular traffic.
   DEVELOPER. Any person dividing or proposing to divide land so as to constitute a subdivision, including any agent of the developer.
   ENGINEER. The City Engineer or his or her duly authorized representative.
   FRONTAGE. All the property on one side of a roadway between two roadway intersections, crossing or terminating, measured along the line of the roadway, or if the roadway is a dead end, then all of the property abutting on one side between a roadway intersection and the dead end of the roadway.
   FRONT LOT LINE. The property line dividing a lot from a roadway. On a corner lot, only one roadway line shall be considered as a front line, and the shorter roadway frontage shall be considered as the FRONT LOT LINE, unless otherwise indicated by the original plat of record.
   FRONT PROPERTY LINE. The boundary line of a lot or parcel of land which abuts upon the boundary line of one or more roadways or highways, and not the center line of the roadway or highway.
   INTERIOR LOT. A lot other than a corner lot.
   LOT. A individual parcel of land occupied or intended for occupancy by a person who intends to use that land in any way permitted in zoning regulations.
   LOT AREA. The total horizontal area within the lot lines of a lot.
   LOT CORNER. A lot abutting upon two or more roadways at their intersection.
   LOT DEPTH. The mean horizontal distance between the front and rear lot lines.
   LOT LINES. The lines bounding a lot.
   LOT WIDTH. The mean distance between the side lines of a lot.
   MINIMUM LOT WIDTH. The minimum frontage at the required front yard line, or building lien of radial lots.
   PARKWAY. See BOULEVARD.
   PERSON. Any individual, firm, corporation, LLC, partnership, joint venture, association, club, fraternal organization, corporation, estate, trust, receiver, organization, syndicate, city, county, municipality, district or other political subdivision, or any other group or combination acting as a unit. This term also includes the agent of a PERSON, as defined above.
   PLACE. An unoccupied open space, other than a roadway or alley, permanently reserved as the principal means of access to abutting property.
   PLAT. A map, drawing or chart showing a developer’s subdivision plan conforming with the requirements of this chapter.
   PRELIMINARY PLAN. A plat conforming to the requirements of § 153.05 of this code.
   REAR LOT LINE. The line opposite the front lot line.
   ROADWAY. The portion of a roadway designed for the use of vehicular traffic; a public or private thoroughfare which affords the principal means of vehicular access to abutting property.
   ROADWAY LINE. A dividing line between a lot, tract or parcel of land and a contiguous roadway.
   ROADWAY WIDTH. The distance between the adjacent front lot lines delineating the right-of-way of the roadway, as measured normally to the center line of the roadway at a point.
   SIDE LOT LINE. Any lot line other than a front lot line or a rear lot line.
   SUBDIVIDE. To divide land and make a SUBDIVISION, as defined herein.
   SUBDIVISION. The division of a tract or parcel of land into two or more parcels, for the purpose, whether immediate or future, of sale or building development. The term includes any and all changes in roadway or lot lines, or re-subdivision. Division of large tract into parcels of ten acres or more, not involving any new roadways or easements of access, shall not be considered subdivision in the meaning of these regulations if the parcel is being sold to a family member for continued use as a residence or farm.
   THOROUGHFARE. A roadway.
   THROUGH LOT. An interior lot having frontage on two roadways.
   TRACT. A parcel of land grater than 43,560 square feet in area, the deed of which was recorded in the office of the Clerk of the County Court prior to the effective date of Ordinance 1961-12.
   ZONE. Same as ZONING DESIGNATION below.
   ZONING. Same as ZONING DESIGNATION below.
   ZONING DESIGNATION. Any area of the city or the unincorporated adjoining area of the county, within which the city’s zoning jurisdiction applies (the two-mile fringe area).
   ZONING MAP. The maps setting forth the boundaries of the zoning designations of the city and the unincorporated adjoining area of the county within which the city’s zoning jurisdiction applies (the two-mile fringe area).
