(a) Any person violating any provision of this Article shall be punished by a fine as follows: within any 12-month period, one hundred dollars ($100.00) for the first offense, two hundred dollars ($200.00) for a second offense, and five hundred dollars ($500.00) for a third or subsequent offense. Each week that such a violation continues, and which shall pose an imminent threat to public health and safety, shall constitute a separate offense.
(b) Such fine, and costs as assessed by the municipal court, together with all attorney fees incurred in the enforcement thereof, and any potential abatement costs identified in Section 1101.05, shall constitute a lien against the real estate of the owner subject to perfecting by filing notice in the Office of the Clerk of the County Commission of Jefferson County, West Virginia.
