§ 90.99 PENALTY.
   (A)   Any person violating any provisions of this chapter, for which no specific penalty is prescribed, shall be subject to § 10.99.
   (B)   (1)   Except as otherwise provided, any person, firm, or corporation violating any of the several provisions of § 90.01(D) shall, upon conviction, be punished by a fine of $25. If the violation continuous in nature, each day such violation shall be permitted to continue shall be considered a separate offense, and shall be punishable as such.
      (2)   The penalty for subsequent offenses shall be:
         (a)   Fifty dollars for the second offense that occurs within 12 months of the prior offense;
         (b)   One hundred dollars for the third offense that occurs within 12 months of prior offenses; and
         (c)   Two hundred dollars for the fourth, and all subsequent, offense that occur within 12 months of prior offenses.

   (C)   (1)   For violation of § 90.01(G), a fine of not less than $250, nor more than $500, is hereby imposed against the owner(s) of any house, building, and/or structure found, and declared, to be a nuisance by resolution of the City Council 30 days after the same has been so found, and declared, to be a nuisance, and for each day thereafter said nuisance be not abated constitutes a separate, and distinct, offense punishable by a fine of $250 for each said separate, and distinct, offense; provided, the notice, as herein provided in § 90.01(F) hereof, has been given within ten days after said house, building, and/or structure has been, by resolution, found, and declared, to be a nuisance.
      (2)   In the event it is deemed advisable by the City Council that a particular house, building, and/or structure be judicially declared to be a nuisance by a court having jurisdiction of such matters, the City Council is hereby authorized to employ an attorney to bring such an action for said purpose in the name of the city, and the only notice to be given to the owner(s) and mortgagee(s), and/or lien holder(s), of any such house, building, and/or structure sought to be judicially declared to be a nuisance will be that as now provided for by law in such cases in Circuit Court. When any such house, building, and/or structure has been declared judicially to be a nuisance by a court of competent jurisdiction, a fine of $100 is hereby imposed against the owner(s) thereof from the date said finding is made by the court, and for each day thereafter said nuisance be not abated constitutes a continuing offense punishable by a fine of $100 per day.

   (D)   Any violation of § 90.03(B)(4) shall be considered an offense punishable by a fine of not less than $50, nor more than $500, and each day of violation may be considered a separate offense.

   (E)   A violation of § 90.15 is hereby declared to be a misdemeanor, and punishable by a fine of not less than $10, nor more than $100, or by a jail sentence of one to ten days. Each day a non-operating motor vehicle is upon the premises of a person shall constitute a separate offense.

   (F)   Violation of § 90.16 shall be a misdemeanor, and upon conviction be subject to a fine of not less than $50, nor more than $100 for a first offense, and a fine of not less than $100, nor more than $500 for second, or subsequent, offenses within one year of the previous conviction.

   (G)   Any person, or firm, or any person, or representative, of a firm, or individual found to be in violation of §§ 90.30 through 90.32 shall be subject to a fine of not less than $50, nor more than $300 for the first offense. Such person, or firm, or person acting on behalf of a person, or firm, shall be fined not less than $150, nor more than $500 for the second offense. Persons, or firms, found guilty of a third, and subsequent, offense shall be fined not less than $500, nor more than $1,000, or imprisoned in the County Jail for a period not to exceed 30 days, or both fines and imprisonment may be imposed.
