§ 90.16 ENGINE BRAKES.
   (A)   Prohibition. No person shall use, or engage, a compression release engine brake, or other hydraulically-operated device that converts a power producing diesel, or gas engine, into a power absorbing retarding mechanism with a correspondingly increased amount of noise emission within the corporate limits of the city, except in the case of failure of the service brake system, adverse weather conditions, or other alternative emergency stopping situations necessitating the use of the compression release engine brake.

   (B)   Exemption. Fire trucks, emergency vehicles, and those municipal vehicles equipped with the Quiet Brake and Silent Partner System are exempted from the requirements of this section.

   (C)   Signage. The Mayor, or the Mayor’s designee, is hereby authorized, and directed, to erect appropriate signs, in accordance with the State Highway Transportation Department requirements, that non-emergency use of unmuffled engine brakes is prohibited within the corporate limits of the city.
