A. Definitions. Unless otherwise indicated in the text of this Section 4.05.030, the following terms as used herein shall have the following meanings. Capitalized terms not defined in this Section 4.05.030 shall have the meaning as set forth in Casa Grande Municipal Code Chapter 13.08, Article I. Capitalized terms not defined in the Casa Grande Municipal Code or this Section 4.05.030 shall have the meanings as set forth herein or the plain and common meaning, unless the context requires otherwise.
1. "Peart Road Sewer Line" is designed with a maximum capacity of 2.8 million gallons per day ("MGD") and its location is generally detailed in Exhibit 1, attached hereto and incorporated herein by this reference.
2. "Inflation Factor" shall mean the quotient of the Engineering News Road Construction Cost Index (ENR) existing in the month preceding the issuance of the building permit for the residential or non-residential land use being connected or serviced by the Peart Road Sewer Line divided by the ENR for April 2003.
3. "Construction Cost" shall mean the base cost of $328,025.25 for the construction of the Peart Road Sewer Line.
B. Collection. The City will collect, along with the building permit fees, a Peart Road Payback Fee from all land uses that are served by and connected to the Peart Road Sewer Line.
C. The residential or non-residential uses that are served by and connected to the Peart Road Sewer Line shall pay, at the time of the City's issuance of a building permit, the Peart Road Payback Fee. The Peart Road Payback Fee is defined by the equation set forth below. The Peart Road Payback Fee will be determined on the amount of sewer line capacity each residential or non-residential use will use in increments of MGD, or portions thereof, based on the ADEQ and City standards existing at the time of building permit issuance for that particular land use and adjusted by the then-existing Inflation Factor.

D. City will only receive reimbursement up to a maximum of the Construction Cost plus Inflation Factor adjustments allowed by this Section 4.05.030.
