Any tree or part thereof, whether living or dead, infected with or attacked by ceratocystis ulmi (the Dutch elm disease), or any other disease or parasite, and any tree which has become hazardous to life or property because of age or neglect of the owner thereof, is hereby declared to be a nuisance, and it shall be unlawful to permit any such tree or part thereof to remain in the city. The director of public works or some other person designated by him is hereby authorized to inspect and examine any tree in the city, to determine whether or not it is infected by the Dutch elm disease, or is in a hazardous condition, as in this chapter set forth. Upon discovering that any such tree is so infected or is in a hazardous condition, as aforesaid, the owner or occupant of the premises shall be notified of this fact. (Ord. 852, 11-18-1980)
It shall be the duty of the owner or occupant of any land upon which such diseased or hazardous tree exists to take action within ten (10) days after such notice to remove and burn said tree, as aforesaid, and shall, within thirty (30) days of said notice have such diseased or infected tree removed and burned.
